29 CFR 1926.1101(h)(1)(ii):      The employer did not ensure that respirators were worn during Class II work where asbestos containing material (ACM) was not removed in a substantially intact state:    On or about September 12, 2011, employees removed transite siding from a residence located at 9515 Grand Division Avenue, Cleveland Ohio.  The siding had been cracked when furring strips had been attached to the exterior walls with nails through the transite in a prior renovation job.  The siding broke when it was pulled free from the wall and when it was broken by employees to fit into buckets.

29 CFR 1926.1101(g)(1)(i):      The employer did not use engineering controls and work practices in all operations covered by this section, regardless of the levels of exposure, in the form of vacuum cleaners equipped with HEPA filters to collect all debris and dust containing ACM and PACM:    On or about September 12, 2011, employees cleaned up debris from a transite siding removal project at a residence located at 9515 Grand Division Avenue, Cleveland Ohio.  Shovels, rakes and other manual methods were used. 29 CFR 1926.1101(g)(8)(iii)(A):      When removing cementitious asbestos containing siding or shingles or transite panels the employer did not assure that cutting, abrading or breaking of panels was prohibited unless the employer can demonstrate that methods less likely to result in asbestos fiber release cannot be used:    On or about September 12, 2011, employees removed transite siding from a residence located at 9515 Grand Division Avenue, Cleveland Ohio.  The siding broke when it was pulled free from the wall by the use of pry-bars; some panels were broken during removal so as to fit pieces into buckets.

Larger sections of the transite were dropped to the ground, smaller pieces were placed in uncovered buckets.
