29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions andthe regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On or about 09/13/11 during the changing of electrical lights at the on and off ramp at Bagley Rd and I-71, the employer did not ensure employees were trained to recognize and abate hazards concerning temporary traffic control operations (TTC); employees did not know correct flagging procedures, when traffic vest were needed, and how and when to set up TTC warning signs.

29 CFR 1926.200(g)(2): Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millenium Edition, December 2000, FHWA. 1. On or about 09/13/11 during the changing of electrical lights at the on and off ramp at Bagley Rd and I-71, the employer did not ensure employees used a flaggers vest or jacket that was either orange, yellow, yellow green or a flourescent versious of hese colors when flagginf traffice as required by the MUTCD section 6E.02. 2. On or about 09/13/11 during the changing of electrical lights at the on and off ramp at Bagley Rd and I-71, the employer did not ensure advance warning signs were in place to warn drivers that flagging operations were taking place as required by the MUTCD section 6G.03.
