29 CFR Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line systems and guardrail systems, warning line system and personal fall arrest system, or warning line system and safety monitoring system:      (a)	Edgar Mercado, 4065 Boymel, Cincinnati, Ohio:  On or about September 13, 2011, at work site located at 934 N. Leavitt Road, Amherst, Ohio, the employer did not ensure that each employee engaged in roofing activities on a pitched roof, with unprotected sides and edges was protected from falling.  Employees were installing roofing material and were exposed to a fall of more than 17 feet to the ground.

29 CFR 1929 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:      (a)	Edgar Mercado, 4065 Boymel, Cincinnati, Ohio:  On or about September 13, 2011, at work site located at 934 N. Leavitt Road, Amherst, Ohio, the employer did not ensure that employees received comprehensive training on the appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems, or alternative measures of fall protection while working on a roof. Employees did not use fall protection and were exposed to approximately 17 feet fall hazard from the roof to the ground.

29 CFR 1926.1053(b)(1):  When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder is used to gain access      (a)	Edgar Mercado,  4065 Boymel, Cincinnati, Ohio:  On or about September 13, 2011, at work site located at 934 N. Leavitt Road, Amherst, Ohio, the employer did not ensure that the extension ladder used to access the roof extended at least 3 feet above the roof edge.  The ladder extended approximately 18 above the roof edge increasing the risk of falling when the employees climbed on to or down from the roof.
