29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest system. a) Anthony Smyers, on or about September 12, 2011, at the address 34254 Chestnut Ridge Road, North Ridgeville, Ohio: the employer did not assure employees were protected from fall hazards while removing roofing material from a roof system. The employees were exposed up to an 18 foot fall to the ground below.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. Employees were not trained to recognize the hazards of falling and in the procedures to be followed in order to minimize these hazards: a) Anthony Smyers, on or about September 12, 2011, at the address 34254 Chestnut Ridge Road, North Ridgeville, Ohio: The employer did not assure employees had been trained in the appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems or alternative measures while performing various roofing operations.
