29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) Jobsite: On September 13, 2011 and times prior thereto employees performing framing activities, including but not limited to, trimming the roof sheathing, did not have a fall protection system in place.      b) Jobsite: On September 13, 2011 and times prior thereto employees performing framing activities on the second floor level were exposed to an unguarded window opening that was less than 39 inches high from the floor.     Note) Abatement certification IS required for this item.

29 CFR 1926.503(a)(2)(ii): The employer did not assure that each employee, as necessary, had been trained by a competent person in the correct procedures for erecting, maintaining, disassembling and inspecting the fall protection systems to be used:    a) Jobsite: On September 13, 2011 and times prior thereto the responsible person on site and employees engaged in various framing activites did not acknowledge the fall hazards they were exposed to and take the appropriate actions to minimize these hazards.      Note) Abatement certification IS required for this item.
