29 CFR 1926.651(b)(3): When excavation operations approach the estimated location of underground installations, the exact location of the installations was not determined by safe and acceptable means: a) On or about September 1, 2011 and times prior, CMS Inc., as the controlling employer did not ensure that J Torres Construction, a subcontractor, protected their employees from injuries in that, a back hoe continued to dig in the vicinity of a known active natural gas line, cutting the gas line with the back hoe bucket instead of hand digging (a safe and acceptable means) in the area, thus exposing employees to serious injuries.

29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) On or about September 1, 2011 and times prior, CMS Inc., as the controlling employer did not ensure that J Torres Construction, a subcontractor, protected their employees from injuries in that, the spoil pile had not been moved back at least two (2) feet from the edge of the excavation. Abatement Verification: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
