29 CFR 1910.219(c)(2)(i): Exposed parts of horizontal were not fully protected: a) On or about September 7, 2011 and times prior, employees were exposed to serious crushing hazards when operating the unguarded Power Take-Off (PTO) driving the vacuum unit. Employees were operating the vacuum in close proximity of the rotating shaft exposing them to being caught in the rotating shaft and seriously injured. Abatement Verification: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.134(e)(1): A medical evaluation was not provided to determine the employee's ability to use a respirator, before the employee is fit-tested or required to use the respirator in the workplace: a) On or about September 7, 2011 and times prior, employees were exposed to illnesses in that, the employees were required to wear N-95 respirators prior to filling out a medical evaluation to determine if they were medically fit to wear the respirator. Abatement Note: The medical evaluation shall obtain the information requested by the questionnaire in Sections 1 and 2, Part A of Appendix C of this standard. The questionnaire shall be evaluated by a physician or other licensed health care professional. Abatement Verification: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
