29 CFR 1910.213(h)(1): The upper hood shall completely enclose the upper portion of the blade down to a point that willinclude the end of the saw arbor. The upper hood shall be constructed in such a manner and of such material that it will protect the operator fromflying splinters, broken saw teeth, etc., and will deflect sawdust away from the operator. The sides of the lower exposed portion of the blade shallbe guarded to the full diameter of the blade by a device that will automatically adjust itself to the thickness of the stock and remain in contactwith stock being cut to give maximum protection possible for the operation being performed. On the south side of the shop, the DeWalt Radial Arm Saw, was inadequately guarded in that the top guard did not cover the end of the arbor.

29 CFR 1910.147(c)(6)(i): The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed. In the workplace, the employer had not conducted, nor documented an inspection of the lockout/tagout procedures. The Strait and Lamp Group was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.147(c)(6)(i), which was contained in OSHA inspection number 313148884, citation number 01, item number 002 and was affirmed as a final order on June 22, 2009, with respect to a workplace located at 5200 Winchester Pike, Canal Winchester, OH. 43110.
