29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents:    (a) Storm Solutions LLC at 725 Lincoln Ave. in Steamboat Springs, CO: On and before September 9, 2011 the controlling employer did not provide and require the use of eye protection when roofers were exposed to eye hazards in that the roofers were not wearing safety glasses when using nail guns.  This exposed the workers to an eye hazard.    Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    (a) Storm Solutions LLC at 725 Lincoln Ave. in Steamboat Springs, CO: On and before September 9, 2011 each employee on a roof with unprotected sides 6 feet or more above the ground was not protected from falling by use of guardrail systems, safety net systems, or personal fall arrest systems in that the controlling employer did not use fall protection and did not ensure that subcontracted roofers were protected from falls while repairing the roof of the Hampton Inn.  This condition exposed the controlling employer and subcontracted roofers to falls of up to approximately 30 feet. 29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:    a) Storm Solutions LLC at 725 Lincoln Ave. in Steamboat Springs, CO:  On and before September 9, 2011 the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Nine subcontractor employees were working on the roof on a three story hotel without the use of a fall protection system. This condition exposed the roofers to a fall hazard of approximately 30 feet to the ground below.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
