29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. (a) Miller Plumbing, LLC on or about September 12, 2011, at the address of 4065 Lake Rd. Sheffield Lake, OH: The employer did not ensure the excavation in which an employee was working was inspected by a competent person at the beginning of each workday and throughout the shift. The need for adequate and effective cave-in protection was not evaluated or recognized prior to permitting employees in a trench excavation.

Sheffield Lake, OH: The employer failed to ensure an employee was adequately protected from cave-ins while installing a residential sanitary line in an 8 ft deep unprotected trench.
