29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from anaerial lift.Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable aspart of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under1926.502(e). a. On the site, the employer did not ensure the employee working from the aerial lift was wearing fall protection. The M P Dory Company was previously cited for a violation of this occupational safety and health standard, 1026.453(b)(2)(v), which was contained in OSHA inspection number 311446397, item number 1 and was affirmed as a final order on 12/19/2007, with respect to a workplace located at 7791 Capital Blvd., Macedonia, Ohio 44056; and during OSHA inspection number 310888763, item number 2 and was affirmed as a final order on 6/19/2007, with respect to a workplace located at Rt. 74 Overpass, Harrison, Ohio 45030.
