29 CFR 1926.95(a): Protective equipment, including personal protective equipment for the eyes, was not used where ever it was necessary by reason of hazards encountered in a manner capable of causing injury or impairment in the function of any part of the body through physical contact. a) D & D Construction and Design, Maumee, Ohio: On or about September 13, 2011, at address 1371 Picadilly Lane, Building 162, OH, the employer failed to ensure that each employee used appropriate eye protection while engaged in nailing activities, such as securing shingles to the structure roof with a pneumatic nailer, exposing employees to eye injuries from flying particles.

1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail systems, warning line system and personal fall arrest system, or warning line system and safety monitoring system: a) D & D Construction and Design, Maumee, Ohio: On or about September 13, 2011, at address 1371 Picadilly Lane, Building 162, Maumee, OH, the employer did not ensure that employees were protected from falls while applying new roofing to a low-sloped roof on an apartment type structure. Employees were exposed to a fall of approximately 17.5 feet to the lower level below.
