29 CFR 1926.501(b)(13): Where the employer was engaged in residential construction activiites 6 feet (1.8) or more above lower levels, employees were not protected by guardrail systems, safety net system, or personal fall arrest system: (a) On or about September 15, 2011, and at times prior, Blue Eagle Roofing and Construction, as the controlling employer, did not ensure that Strong Man Roofing, a subcontractor, protected their employees from falls of 25 feet, in that fall protection was not provided to employees performing re-roofing work on a 5/12 pitched roof. ABATEMENT NOTE: If using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502.
