29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a) Harlan Frey Roofing & Construction, worksite located on 2812 Gleneagle Drive in Findlay, OH: On or about August 11, 2011, the employer did not ensure employees were wearing proper eye protection while operating a pneumatic nail gun to secure new shingles to a residential structure. Employees were exposed to potential flying object hazards while operating the nail gun.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure: a) Harlan Frey Roofing & Construction, located at worksite on Gleneagle Drive in Findlay, OH: On or about August 11, 2011, the employer did not ensure employees were protected from a fall hazard approximately 10 feet above the ground below. The employees were placing new roofing material on a residential structure that had a pitch that was approximately 4/12.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards: a) Harlan Frey Roofing & Construction, located at worksite on 2812 Gleneagle Drive, Findlay OH: On or about August 11, 2011, the employer did not ensure that employees were trained in the proper application of personal fall protection equipment while working on a low sloped residential structure. Employees were exposed to a fall height approximately 10 feet from the ground below.
