Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to hazards while working at elevated heights retrieving or restocking of store merchandise.    Employees were exposed to a fall hazard of approximately ten feet while working from a pallet that was elevated by a fork truck and the employer failed to provide a work platform that meets the design, construction and use requirements in accordance with ASME B56.1-2004, American Society of Mechanical Engineers Safety Standard for Low Lift and High Lift Trucks.     A restraining means such as a guardrail or a means for securing personnel such as a body belt or lanyard was not used.

29 CFR 1910.178(m)(5)(i): Powered industrial trucks were left unattended without the load engaging means being lowered:    Employees used an elevated work platform that was attached to an Allis Chalmers Forklift. The platform was raised to a height of approximately 10 feet and the powered industrial truck was left unattended while the load engaging means was raised.

29 CFR 1910.272(g)(1)(ii):  Prior to entry, all mechanical. Electrical, hydraulic, and pneumatic equipment which presented a danger to employees inside bins, silos, or tanks in the grain handling facility were not disconnected, locked out and tagged, blocked off, or prevented from operating by other means or methods:     Employees were exposed to amputation hazards while entering a grain bin, containing corn.  The mechanical and electrical equipment was not disconnected and/or deenergized prior to entering the grain bin.

29 CFR 1910.272(m)(4): The employer did not implement procedures in the grain handling facility for the use of tags and locks which would prevent the inadvertent application of energy or motion to equipment being repaired, serviced, or adjusted, which could result in employee injury:    Employees who were performing servicing and maintenance functions at the plant are exposed to the unexpected energization of the equipment because an energy control procedures had not been developed, documented, or utilized to ensure the energy is controlled during this and other service and maintenance operations at the facility.    These energy control procedures would include a written lockout/tagout program, machine specific procedures, employee assigned locks and tags, a periodic inspection of the energy control procedures done at least annually, and employee training.
