29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for the frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    The employer failed to conduct routine and regular job site inspections in that employees were exposed to falls while spreading aggregate over a flat membrane roof due to inadequate utilization of fall protection abatement measures (i.e. such as a combination warning line and safety monitor system).    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.501(b)(10):  Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, net systems, personal fall arrest systems, or a combination of warning line and guardrail systems, warning line and personal fall arrest systems, or warning line and safety monitoring systems:    The employer failed to ensure that employees working from a 60W x 250L flat roof at a ground to eave elevation in excess of 50 were afforded fall protection.
