29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: Employees were exposed to a cave-in hazard while accessing an unprotected excavation to stand on top of a trench box to continuously monitor an operating water pump, and a competent person had not performed frequent and regular safety inspections of the construction site to identify and eliminate the hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) sloping and benching systems, or paragraph (c) support systems, shield systems, and other protective systems: Employees were accessing an unprotected excavation to stand on top of a trench box to continuously monitor an operating water pump at a depth of approximately 9 feet deep, and the excavation was not sloped, shored, or braced in accordance with the standard.
