29 CFR 1926.28(a): The employer did not require the wearing of approriate personal protective equipment in all operations where there was an exposure for hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to employees. (a) Rear deck of structure: On or about September 15, 2011, and at times prior thereto, an employee was observed utilizing a pneumatic nail gun and not utilizing safety glasses. (b) Rear deck of structure: On or about September 15, 2011, and at times prior thereto, an employee were observed not utilizing protective helmets when exposed to overhead hazards. Note: Abatement certification IS required for this item.
