29 CFR 1910.147(c)(4)(i):     Procedures shall be developed, documented and utilized for the control of potentially hazardousenergy when employees are engaged in the activities covered by this section. Note: Exception: The employer need not document the required procedure for a particular machine or equipment, when all of the followingelements exist: (1) The machine or equipment has no potential for stored or residual energy or reaccumulation of stored energy after shut down whichcould endanger employees; (2) the machine or equipment has a single energy source which can be readily identified and isolated; (3) the isolation andlocking out of that energy source will completely deenergize and deactivate the machine or equipment; (4) the machine or equipment is isolated fromthat energy source and locked out during servicing or maintenance; (5) a single lockout device will achieve a locker-out condition; (6) the lockoutdevice is under the exclusive control of the authorized employee performing the servicing or maintenance; (7) the servicing or maintenance does notcreate hazards for other employees; and (8) the employer, in utilizing this exception, has had no accidents involving the unexpected activation orreenergization of the machine or equipment during servicing or maintenance.    a. In the workplace, employee(s) required to service the cutter tip on the Hypertherm Plasma Cutter were not required to utilize the established hazardous energy control procedure for the Hypertherm Plasma Cutter.

29 CFR 1910.147(c)(7)(i):     The employer shall provide training to ensure that the purpose and function of the energy controlprogram are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls areacquired by employees:      a. In the workplace, employee(s) who the employer had designated "affected" were required to perform maintenance on the Hypertherm Plasma Cutter, and the affected employee(s) were not provided with the knowledge and skills necessary to safely de-energize, isolate, and apply lock out devices, to perform the maintienance safely.

29 CFR 1910.212(a)(3)(ii):     The point of operation of machines whose operation exposes an employee to injury, shall beguarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards,shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operatingcycle.    In the workplace, the Wysong Shear, model 1010-RD, serial number P32-631, was not guarded in that the hold downs had an 1/2 - 5/8" opening, and there was access to the shear blade.
