Third Act Pictures Inc. did not conform to Section 6G.03 of the Manual on Uniform Traffic Control Devices, Millenium Edition when employees worked in and near the traveled ways of West Main Street and North West Street without providing advance warning to approaching road users of construction activity. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated. Third Act Pictures, Inc. employees without personal fall arrest systems or personal fall restraint systems worked in an areial lift (JLG model AJ80) at elevations up to 22 feet. The employees were working on a structure that was being demolished. There is no abatement documentation or certification required for this item.
