29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: A: On or about 9/22/11 during excavation activities, the employer did not ensure a safe means of egress was used when a worker exited an excavation that measured between 5.5 and 7 feet deep, 59.1 feet in length, and 12.1 feet in width. The slope at which the worker exited the excavation was 60.781 degrees. B: On or about 9/22/11 during excavation activities, the employer did not ensure a safe means of egress was provided to an employee when exiting an excavation that measured between 4 and 7 feet deep, 59.1 feet in length, and 12.1 feet in width. The point at which the employee exited the excavation consisted of a vertical wall that was 4 feet in depth.

On or about 9/08/11 during the building of a retention wall, the employer did not ensure workers were protected from an excavated wall that was 22 feet in height. B: On or about 9/22/11 during excavation activities, the employer did not ensure a worker was protected from a cave in while working in an excavation that measured between 5.5 and 7 feet deep, 59.1 feet in length, and 12.1 feet in width. C: On or about 9/22/11 during excavation activities, the employer did not ensure an employee was protected from a cave in while working in an excavation that measured between 5.5 and 7 feet deep, 59.1 feet in length, and 12.1 feet in width.
