29 CFR 1926.1051(a):     A stairway or ladder were not provided at all personnel points of access where there is a break inelevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided:     (a) On the east sides of tank 1 and tank 2 on or about September 14, 2011, and at times prior thereto, no access ladder,stairs, r amp, runway, sloped embankment, or personnel hoist were provided when the bottom of the tank openings were 40 inches above the ground.  Employees regularly accessed the tanks through the openings that were about 35 inches wide by 23.5 inches high.
