29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    (a)Prime Group, LLC @ 10025 Girard Ave., Denver, CO 80231:  On and before September 15th, 2011, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees on-site were permitted to work in an excavation without a protective system in place. The condition exposed employees to crushing hazards as a result of being exposed to 7' wall of unsupported soil.     Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.651(b)(3): When excavation operations approached the estimated location of underground installations, the exact location of the installations was not determined by safe and acceptable means:    (a)  Prime Group, LLC @ 10025 E. Girard Ave., Denver, CO 80231: On and before September 15th, 2011, the exposing employer did not ensure employees working within a trench to fix a water main break, took the necessary steps of specifically locating the buried utilities. The supervisor instructed the employees to hand dig the trench without specifically determing the location of utilities within the excavation. In not specifically locating the utilities, employees were exposed to fire, explosion, and electircal hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected fromcave-ins by an adequate protective system designed in accordance with paragraphs (b) or (c) of this section:    (a) Prime Group, LLC. @ 10025 E. Girard Ave., Denver, CO 80231:  On and before September 15th, 2011, the exposing employer did not ensure each employee conducting work activities in the excavation was protected from cave-in. The excavation was approximately 7 feet deep and 8 feet long. The excavation lacked any protective system, such as appropriate sloping, benching, or shield system.  This condition exposed the employees to a crushing hazard by excavation wall cave-in.
