29 CFR 1910.132(a):  Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    On or about September 29, 2011, in the facility, employees were required to wear puncture resistance gloves and natural rubber gloves when deboning chicken parts.  The employees were not consistently provided maintained, sanitary and/or reliable quality gloves.   As a result, employees personally laundered gloves off the premises to ensure a more reliable quality of glove for use at the facility.

29 CFR 1910.132(h)(5):  The employer must pay for replacement PPE, except when the employee has lost or intentionally damaged the PPE.    a.  On or about September 29, 2011, employees were required to wear cut resistant gloves when deboning chicken parts.  The employer required employees to purchase replacement gloves after the item(s) became damaged or deemed unreliable after normal use.  The employer did not pay for the replacement personal protective equipment required to be used by the employer.

29 CFR 1910.1200(e)(1):  Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:    a.  On or about September 29, 2011, in the facility, employees were required to work with materials containing potassium hydroxide, sodium hypochlorite and carbon dioxide.  The employer had not developed and implemented a written hazard communication program including, but not limited to labeling, material safety data sheets, and training procedures.

29 CFR 1910.1200(h)(1):  Employees were not provided information and training as specified in 29 CFR 1910.1200(h)(1) and (2) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area:    On or about September 29, 2011, in the facility, employees were required to work in a room where carbon dioxide gas was used.  The employer failed to provide employees with accurate information which depicted the correct identity of the hazardous material being used in the workplace, associated hazards and proper warning signs of exposure.
