Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment or a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to fall hazards:      a)  On or about September 27, 2011, and at times prior, employees were exposed to fall hazards while they used a 6 foot fiberglass step ladder to access a rooftop that was approximately 8 feet high.  Employees stood on the top two steps/rungs of the ladder and used their hands to pull or push themselves onto the roof.  Stepping on the top two rungs could have made the ladder unsteady and was in violation of the ladder manufacturers recommendations and warnings posted on the ladder.        Abatement:  Among other methods, one feasible and acceptable abatement method to correct the hazard would be to follow the manufacturers warnings and not use the top rungs of the ladder.  The employer should install either a fixed ladder or purchase a portable ladder of sufficient length and design to allow employees to safely access the roof.
