29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a. On or about September 21, 2011, at the above addressed jobsite, an employee performing carpentry operations from the roof deck. section, 1 was exposed to falls, of twenty-eight (28') feet, created by the presence of unprotected sides.    b. On or about September 21, 2011, at the above addressed jobsite, an employee performing carpentry operations from the roof deck, section, 2 was exposed to falls, of seventeen (17') feet eight (8") inches, created by the presence of unprotected sides.

Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, shall be protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.    a. On or about September 21, 2011, at the above addressed jobsite, employees performing carpentry operations from the roof deck, section two was exposed to a fall of seventeen (17') feet eight (8") inches, created by the presence of a wall opening.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab rail, shall be provided to assist employees in mounting and dismounting the ladder.  In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.    a.  On or about September 21, 2011, at the above addressed jobsite, the portable ladder used to access the roof, section one, did not extend at least three (3') feet above the upper landing surface nor was it secured, thereby exposing employees to the hazards associated with falls.

On or about September 21, 2011, at the above addressed jobsite, an employee performing carpentry operations was standing on the top step of an A Frame ladder, thereby expostng the employee to the hazards associated with falls.
