29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:      a) North side of foundation, offset area for stairs; On or about September 21, 2011 and at times prior thereto, as the controlling employer, employees of a subcontractor were allowed to work immediately adjacent to a nearly vertical 8.5 to 10 foot high excavated wall.        Note: Abatement certification is NOT required for this item.

29 CFR 1926.652(b)(4)(ii): Designs were not in written form:      a) North side of foundation, offset area for stairs; On or about September 20, 2011 and at times prior thereto, as the controlling employer, employees of a subcontractor were allowed to work immediately adjacent to a nearly vertical 8.5 to 10 foot high excavated wall.  There was not a written sloping design approved by a professional engineer when the excavation was constructed and/or when subcontractors employees were in the excavation.    Note: Abatement certification is NOT required for this item.
