Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    a.  On or about September 21, 2011, at the above addressed jobsite, employees installing a sewer line in an excavation were not protected from materials falling into the excavation, in that the spoil pile was less than two (2) feet from the edge of the excavation.

29 CFR 1926.652(a)(1):  Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    a. On or about July 28, 2011, at the above addressed jobsite, employees were installing a sewer line in an excavation measured at six (6) feet five (5) inches in depth.  The excavation was not provided with cave in protection, thereby exposing the employees to cave in hazards.
