29 CFR 1926.1101(f)(2)(i):  The employer with a work operation covered by the asbestos standard did not ensure that a "competent person" conducted an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation:    a)  On or about September 1, 2011, and at times prior, PTL Services did not provide employees with an initial exposure assessment to ensure they were not exposed above the permissible exposure limit for asbestos while they cut asbestos wall texturing or worked around areas where it had been disturbed.  In addition, employees of Metro Construction (general contractor) and Riverstone Residential (building occupants) worked in the area during and after disturbance of the asbestos wall texturing.

29 CFR 1926.1101(e)(1):  All Class I, II, and III asbestos work was not conducted within regulated areas:    a)  On or about September 1, 2011, and at times prior, employees of Metro Construction (general contractor),  PTL Services (subcontractor) and Riverstone Residential (building occupants) were exposed to asbestos fibers while working near Class III asbestos operations without being separated by a demarcated regulated area.  PTL Services did not set up and demarcate a regulated area while their employees cut into asbestos wall texturing.

29 CFR 1926.1101(o)(1):  The employer did not designate a competent person on construction worksites, having the qualifications and authorities for ensuring worker safety and health required by Subpart C, General Safety and Health Provisions for Construction (29 CFR 1926.20 through 1926.32):    a)  On or about September 1, 2011, and at times prior, PTL Services, as a creating employer, did not ensure that their employees and those of Metro Construction (general contractor) and Riverstone Residential (building occupants) were protected through the supervision of a competent person knowledgeable in the hazards and control methodologies associated with asbestos work.  Employees of all three companies working in the area were exposed to asbestos fibers while PTL employees cut through asbestos wall texturing without using adequate control methods.

29 CFR 1926.1101(k)(9)(i):  The employer did not institute a training program for all employees who are likely to be exposed in excess of a PEL and for all employees who perform Class I through Class IV asbestos operations, and did not ensure their participation in the program:    a)  On or about September 1, 2011, and at times prior, the employer did not ensure that employees were provided with adequate training in asbestos work.  Employees were exposed to asbestos fibers while they disturbed asbestos wall texturing or worked in the area around the disturbed material or other asbestos containing materials.

29 CFR 1926.1101(h)(3)(iii)[A]:  Employers must provide employees with an air-purifying half mask respirator, other than a filtering facepiece respirator,  whenever the employees perform Class III asbestos work involving disturbance of TSI or surfacing ACM or PACM:    a)  On or about September 1, 2011, the employer failed to provide adequate respirators to employees that cut asbestos wall texturing or worked in the area while it was being cut.
