29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace: (Construction Reference 1926.103) (a) Glacier Construction Co., Inc. at 1201 Ash Ave., Greeley, CO 80631: The employer did not identify and evaluate the respiratory hazards in the workplace. Employees are cutting into the concrete building and grinding on pipes. The employer did not evaluate employee exposure to the respiratory hazards. This condition exposed employees to inhalation hazards such as but not limited to respirable crystalline silica and various metal particulates. Abatement Note: Paragraph K requires the employer to provide effective training to employees who are required to use respirators. The employer is also required to provide the basic information on respirators in Appendix D to employees who wear respirators when not required by the employer to do so. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

(a) Glacier Construction Co., Inc. at 1201 Ash Ave., Greeley, CO 80631: On and before 9/28/11, the employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. Employees performing hand grinding and concrete cutting were exposed to respirable silica. Employees were using filtering facepiece respirators and half face respirator. This condition exposed employees to the physiological hazard of wearing respiratory protection without proper evaluation by a physician or other licensed health care professional. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

The tanks on site had been evaluated as permit required spaces. Employers did not identify these spaces by posting danger signs or by any other equally effective means.
