29 CFR 1926.652(g)(2): Excavations of earth material to a level no greater than 2 feet(.61m) below the bottom of a shield was permitted: Employees working in a 9 feet deep excavation were exposed to a cave-in hazard due to the employer carrying the bottom of the trench box 3 feet above the bottom of the trench.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: Employees were working in an excavation which was not inspected by a competent person before the employees were allowed to enter the working area. The trench box was being carried approximately 3 feet above the bottom of the excavation.
