OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards created by the improper operation and maintenance of the Caterpillar M320 wheeled excavator. a. All Recycling Management, LLC site located at 10351 Allen Twp. Rd. 107, Findlay, Ohio: On or about September 30, 2011, the employer did not ensure the Caterpillar M320 wheeled excavator PIN#6WL00606, Model # M320, did not exceed its rated 10,000 capacity when attempting to lift an 18,000 pound piece of equipment, exposing employees to struck-by and crushing hazards when the main boom on the excavator cracked on three of its four sides. b. All Recycling Management, LLC site located at 10351 Allen Twp. Rd. 107, Findlay, Ohio: On or about September 30, 2011, the employer did not ensure the Caterpillar M320 wheeled excavator PIN#6WL00606, Model # M320, had its capacity rated after repairs were made to the main boom on or about November 15, 2010, exposing employees to struck-by and crushing hazards due to its decreased capacity. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with Caterpillar Operations and Maintenance Manual M318 and M320 Excavators (December 2000) and Association of Equipment Manufacturers (AEM) Hydraulic Excavator: Safety Manual for Operating and Maintenance Personnel (2005), but not limited to: a) Ensure employees are not lifting materials and equipment which exceeds the rated capacity of the excavator. b) Ensure the excavators capacity is properly rated following the modifications made to the main boom.
