29 CFR 1910.1030(h)(5)(i): The employer did not establish and maintain a sharps log for the recording of percutaneous injuries from contaminated sharps:    a) On or about September 13, 2011 and at time prior, the employer had not maintained a sharps injury log to cover the calendar year 2009 in that there were 2 needlestick incidents that occurred in that year.     On November 8, 2009, an employee received a puncture wound in the right thumb from an insulin needle in which the safety cap failed to work.      On August 3, 2009, an employee received a needle stick from a Kendall hollow-bore 23-gauge needle with the protective mechanism. While trying to recap the contaminated needle, the employees left index finger was poked before the protective mechanism could be activated.

29 CFR 1904.7(b)(3): The employer did not record an injury or illness that involves one or more days away from work, on the OSHA 300 log with a check mark in the space for cases involving days away from work:    a) On or about September 13, 2011, Conifer Care Communities dba Christopher House, as the exposing employer, did not record the following workplace injuries and illnesses correctly on the OSHA 300 Log for calendar 2008:    On or about May 16, 2008, Entry #801 was recorded as a job transfer in Column (I), when the case resulted in both days away from work as well as job restriction Column (I). The correct recording should be a check in Column (H), 4 days in Column (K) and 11 days in Column (L).    On or about July 4, 2008, Entry #803 was recorded with 3 days in Column (K). The correct recording should also include a check In Column (H).    On or about October 19 2008, Entry #806 was recorded with a check in Column (I) and 5 days in Column (K). The correct recording should be a check in Column (H), 4 days in Column (K) and 11 days in Column (L)      b) On or about September 13, 2011, Conifer Care Communities dba Christopher House, as the exposing employer, did not record the following workplace injuries and illnesses correctly on the OSHA 300 Log for calendar 2009:    On or about August 22, 2009, Entry #906 was recorded with a check in Column (L), 2 days in Column (K) and as an injury in Column (M1).  The correct recording should be a check in Column (H), 2 days in Column (K), 60 days in Column (L) and a check in Column (M1). The employers corrected OSHA 300 form has this entry renumbered now as Entry #903.      c) On or about September 13, 2011, Conifer Care Communities dba Christopher House, as the exposing employer, did not record the following workplace injuries and illnesses correctly on the OSHA 300 Log for calendar 2011:    On or about January 21, 2011, Entry #912 was only recorded as a job transfer or restriction in Column (I). The correct recording should be a check in Column (H), 8 days in Column (K) and 180 days in Column (L).    On or about April 15, 2011, Entry #917 was recorded as a job restriction with a check in Column (I) and 2 days away from work in Column (K).  The correct recording should be a check in Column (H), 2 days in Column (K) and 15 days in Column (L).     On or about August 20, 2011, Entry #918 was recorded as a job restriction in Column (I). The correct recording should be a check in Column (H), 2 days in Column (K) and 15 days in Column (L).        Definitions:  Column (H) is to record Days Away From Work.  Column (I) is to record Days of Job Transfer or Restriction. Column (J) is to record Other Recordable Cases. Column (K) is to record the number of days away from work. Entry #910 resulted in days of restricted activity. Column L (number of days of restricted activity) was blank. Column L should have been recorded as 59 days.    An injury occurring on January 21, 2011 was not recorded on the OSHA 300 for the Year 2011 within 7 calendar days of receiving information that a recordable injury had occurred. (If you had no recordable cases, enter zeros for each column total):    a) On or about September 13, 2011,  Conifer Care Communities dba Christopher House, as the exposing employer, did not adequately complete the OSHA 300A Form:    The employers OSHA 300A (or equivalent) for the years 2008, 2009 and 2010 contained blanks for Column (L). Column (L) is the total number of days of job transfer or restriction.    The employers OSHA 300A (or equivalent) for the Year 2008 contained incorrect totals in Columns (I), (J), (K), (L) and (M1).   The DART rate with these incorrect totals was 4.2.
