29 CFR 1910.157(b)(1):     Where the employer has established and implemented a written fire safety policy which requires the immediate and total evacuation of employees from the workplace upon the sounding of a fire alarm signal and which includes an emergency action plan and a fire prevention plan which meet the requirements of 29 CFR 1910.38 and 29 CFR 1910.39 respectively, and when extinguishers are not available in the workplace, the employer is exempt from all requirements of this section unless a specific standard in part 1910 requires that a portable fire extinguisher be provided.    a)  Facility wide: On or about August 9, 2011, and at times prior thereto, the Emergency Action Plan and the Fire Evacuation Plan Maps posted did not show the current changes in the evacuation routes and reclassifications of Bays 1 thru Bay 6 in use.

29 CFR 1910.178(l)(4)(iii):     An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.    a)  Facility - On or about August 9, 2011, and at times prior thereto, Bobcat operators did not have current training.  The last equpment training was 3 August 2006 and expired in 2009.  Operators were trained on different classes of equipment not currently used onsite.

29 CFR 1910.305(b)(1)(ii):     Unused openings in boxes, cabinets, or fittings were not effectively closed:      a)  Northwest - Steam Cleaner Area: On August 9, 2011 , and at times prior thereto, a General Electric knife switch control box was missing a knockout on the underside which supplied power to the steam cleaner.    b)  North wall, Bay 2:  On August 9, 2011 , and at times prior thereto, a General Electric knife switch control box was missing a knockout on the underside which supplied power to the Petroleum, Oil, and Lubricant area (POL).    c)  South, Tool Room:  On August 9, 2011 , and at times prior thereto, a Square D Company safety knife  switch control box was missing a knockout on the upper right side.    d)  West - Break room:  On August 9, 2011 , and at times prior thereto, a 4 square mounted metal box was missing a knockout on the underside which supplied power to the microwave and coffee maker.

29 CFR 1910.305(g)(1)(iii):    Flexible cords and cables are prohibited as a substitute for fixed wiring.    a)  Southwest, Across from Bays 5 and 6: On or about August 9, 2011, and at times prior thereto, a flexible cord was used in place of fixed wiring running across the exit door to a nearby outlet creating an electrical and fire hazard.

29 CFR 1960.30(a):     The agency shall ensure the prompt abatement of unsafe and unhealthful conditions. Where a Notice of an Unsafe or Unhealthful Working Condition has been issued, abatement shall be within the time set forth in the notice, or in accordance with the established abatement plan.    a)  Facility - Main Shop Floor: On August 9, 2011 and at times prior thereto, the Vehicle exhaust system when used draws less than 7000 cfm for Bays 1 through Bay 4 creating a breathing hazard to floor mechanics and incidental personnel in the immediate area. This condition existed since 1996.
