29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) For the employees exposed to cave-in hazards from a trench that had vertical walls of 11 feet and 6 feet without a means of employee protection at the Extended Stay Motel in Dickinson, ND. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 310448147, Citation 1, Item 1, and was affirmed as a final order on December 12, 2006, with respect to a workplace located at 224 Elk Street, Rapid City, SD.
