29 CFR 1910.157(e)(2) : Portable extinguishers or hose used in lieu thereof under paragraph (d)(3) of this section were be visually inspected monthly:    (b) In the office interior near the front entrance on or about October 11, 2011 and at times prior thereto, the fire extinguisher was not inspected monthly as the tag indicated the extinguisher was last inspected in August 2011.  The safety manager for the base said the base fire department requires the extinguishers to be inspected every month and the tags to be completed monthly.  Office employees were expected to use the extinguisher according to the managers.    (b)In the carpenters' shop near the south entrance on or about October 11, 2011 and at and at times prior thereto, the fire extinguisher was not inspected monthly as the tag indicated the extinguisher was last inspected in August 2011.  The safety manager for the base said the base fire department requires the extinguishers to be inspected every month and the tags to be completed monthly.  Carpenter shop employees were expected to use the extinguisher according to the managers.    THE CALIDAD INDUSTRIES WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1910.157(E)(2) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313587016 CITATION NUMBER 1, ITEM NUMBER 1B, ISSUED ON NOVEMBER 20, 2009, WITH RESPECT TO A WORKPLACE LOCATED AT CAMP PARKS, BLDG. 791 & FIELD, DUBLIN, CALIFORNIA.

29 CFR 1910.157(b)(1): Where the employer has established and implemented a written fire safety policy which requires the immediate and total evacuation of employees from the workplace upon the sounding of a fire alarm signal and which includes an emergency action plan and a fire prevention plan did not meet the requirements of 29 CFR 1910.38 and 29 CFR 1910.39 respectively, and when extinguishers are not available in the workplace, the employer is exempt from all requion rements of this section unless a specific standard in part 1910 requires that a portable fire extinguisher be provided.    (a).  At the warehouse on or about October 11, 2011, and at times prior thereto, the employer did not have a written fire prevention plan. The warehouse supervisor said employees were expected to evacuate the are and not to use the fire extinguishers.  Since the warehouse was constructed primarly made of wood, according to the base safety manager, and the base fire department wanted the employees to evacuate and not to use the fire extinguishers to fight the fire.
