29 CFR 1926.20(b)(4):  The employer failed to permit only those employees qualified by training or experience to operate equipment and machinery:    (a)  On or about July 28, 2011, and at times prior to this date, an employee was ordered to operate a Case Skid-Loader to back fill basement walls without adequate training to prevent common hazards unique to this piece of equipment such as but not limited to accidental tip over.
