29 CFR 1926.95(a):     Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment:    Country Home Remodeling, conducting work at 2649 US Highway 20, Swanton, OH: On or about October 12, 2011, the employer failed to ensure that employees were wearing appropriate eye protection such as, but not limited to, safety glasses while securing wooden trusses on a low slope roof of a one story commercial building with a battery powered Paslode nail gun. Employees were exposed to the hazards of eye injury from flying objects.    No additional abatement information is needed for this item.

29 CFR 1926.100(a):     Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:    Country Home Remodeling, conducting work at 2649 US Highway 20, Swanton, OH: On or about October 12, 2011, the employer did not ensure that the employee was protected from head injury hazards by protective hard hat while installing wooden trusses on a low slope roof of a one story commercial building. The employee was exposed to potential impact injuries caused by falling materials when the employee was standing underneath a wooden truss while it was being elevated to the roof of the building. 29 CFR 1926.503(a)(1):     The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    Country Home Remodeling, conducting work at 2649 US Highway 20, Swanton, OH: On or about October 12, 2011, the employer failed to ensure that employees had been trained in the appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems, or alternative measures of fall protection while installing wooden trusses on a low slope roof of a one story commercial building. Employees did not use fall protection and were exposed to approximately an 11 foot fall hazard from the roof to the ground below.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

The employees were exposed to approximately an 11 foot fall hazard when using the ladder to access the working level in order to install wooden trusses on the roof. 29 CFR 1926.602(d):     The employer did not certify that each powered industrial vehicle operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):    Country Home Remodeling, conducting work at 2649 US Highway 20, Swanton, OH: On or about October 12, 2011, the employer did not ensure that employees, operating the powered industrial vehicle JCB (Type 550-170, Identification # JCB5AMSGC81510666), were competent to complete the task, exposing employees to struck-by, caught in between, and tip over hazards. The employer did not ensure that each forklift operator received formal instructions and practical training on how to operate a powered industrial vehicle, as well as the operators performance was not evaluated.
