29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure: Garcia's Roofing, at 5811 Auburn Drive, Fort Collins, CO: On 9/30/11, Garcia's Roofing did not ensure that each employee engaged in residential construction activities 6 feet or more above lower levels was protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure. Garcia's Roofing was replacing a two story tall home's roof. Employees were not protected by a guardrail system, safety net system, or personal fall arrest system. This condition exposed employees to an approximate twenty foot fall hazard.

29 CFR 1926.1053(b)(6): Ladders were used on surfaces which were not stable and level: Garcia's Roofing, at 5811 Auburn Drive, Fort Collins, CO: On 9/30/11, Garcia's Roofing did not ensure that ladders were used on surfaces which were stable and level. Garcia's Roofing was replacing a two story tall home's roof. Employees used an aluminum extension ladder to access the second story roof from the peak of the first story roof. The ladder rested upon a stack of shingles on the peak of the first story roof. The ladder side rails rested against the sloped second story roof. The ladder side rails were not secured. The employer did not ensure that the ladder was stable or secure. This condition exposed employees to an approximate twenty foot fall hazard.
