29 CFR 1926.304(h)(1): Each circular crosscut table saw was not guarded by a hood which completely enclosed that portion of the saw blade above the table and that portion of the saw above the material being cut: (a) On or about October 6, 2011, and at times prior to that date, for the employees cutting trim and other construction materials on a Dewalt table saw, Model DW744, located at 6709 South Minnesota Avenue, Sioux Falls, South Dakota.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) On or about October 6, 2011, and at times prior to that date, for the employees working on the second floor of the project working around the center stair well opening with a top rail and no mid rail protection and exposed to a potential fall hazard of approximately 12 feet, located at 6709 South Minnesota Avenue, Sioux Falls, South Dakota. (b) On or about October 6, 2011, and at times prior to that date, for the subcontractor's employees working on the second floor of the project taping sheet rock in a room and exposed to a potential fall hazard of approximately 12 feet where the general contractor removed the guardrail system on the east wall of the room, located at 6709 South Minnesota Avenue, Sioux Falls, South Dakota.
