OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that:    On or about October 14, 2011 and prior to that time in the parking lot area employee(s) performing tree triming associated operations from within or beside the approximate 10' elevated basket of a Genie PLI vertical mast aerial lift were exposed to the hazards associated with aerial lift collapse, fall and struck by injuries due to unsecured, side loaded aerial lift being transported while elevated and occupied on the forks of a Mitsubishi Model FGC 25K forklift.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) On or about October 14, 2011 and prior to that time located at various areas of the facility employees authorized to operate forklift(s) performed duties such as relocating trailors and lifting / relocating inadequately arranged unsecured occupied elevated aerial lift(s) on the forks of a forklift who were not trained, evaluated and or provided refresher training on the workplace hazards associated with forklift operation and the requirements of the regulation.

29 CFR 1910.178(o)(1): The employer did not ensure that only stable or safely arranged loads were handled:    a) On or about October 14, 2011 and prior to that time located at various areas or the facalite a Mistubishi Model FGC 25K forklift was being used to side load lift and transport an elevated occupied Genie PLI vertical mast aerial lift on the raised forks or the forklift without ensureing the load / aerial lift was stable or safely arranged exposing the aerial lift occupant to a hazard potential of the aerial lift sliding off the forks and an approximate 10' fall or the falling aerial lift striking ground worker(s) or the forklift operator.
