OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On or about October 14, 2011 and prior to that time in the parking lot area employee(s) performing tree triming associated operations from within or beside the approximate 10' elevated basket of a Genie PLI vertical mast aerial lift were exposed to the hazards associated with aerial lift collapse, fall and struck by injuries due to unsecured, side loaded aerial lift being transported while elevated and occupied on the forks of a Mitsubishi Model FGC 25K forklift.
