OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to hazards associated with uncontrolled movement of railcars in the company's rail yard. On or about October 14, 2011, at 14600 South Wood Street, Harvey, IL. 60426, an employee(s) was required to use a Case 621D Wheel Loader with a bucket attachment to push railcars on the tracks in the company's rail yard. Other employee(s) in the rail yard were thereby exposed to the hazards associated with the uncontrolled movement of railcars. An employee was fatally injured when a railcar pushed by the Case 621D Wheel Loader struck a locomotive crane.
