29 CFR 1910.178(l)(2)(ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. Dale Thornton dba T & T Recycling had employees operating powered industrial trucks without first completing operator training as specified in 1910.178, paragraph (l). The training provided did not include the following: a. Practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and b. Evaluation of the operators performance in the workplace.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. 29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage shall be separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour. Dale Thornton dba T & T Recycling had employees exposed to fire and explosion hazards, due to the storage of an acetylene compressed gas cylinder directly next to an oxygen compressed gas cylinder, on a welding cart.
