29 CFR 1926.651(c)(2):     A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    On or about October 20, 2011 an employee was working in a trench at a depth greater than 4 feet laboring to find a leak in a water main between a storm sewer and teh backhoe without a safe means of egress exposing the employee to being unable to exit the trench in a trench in an emergency.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c)

29 CFR 1926.651(i)(3):     Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures:    On or about October 20, 2011 employees were working in a trench laboring to find a leak in a water main with an undercut portion of the street was not supported exposing employees to a struckby hazard.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c)

29 CFR 1926.651(j)(2):     Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    On or about October 20, 2011 employees were working in a trench laboring to find a leak in a water main with fill material rocks, gravel, and a shovel located within two (2) feet of the edge of the trench exposing the employees to struckby hazards.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c)

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.    On or about October 20, 2011, the employer did not ensure that the competent person examined the excavation prior to employees entering the excavation to look for a leak in a water main.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d)
