29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck was not taken out of service until it has been restored to safe operating condition. Employees operated the Caterpillar #10 rider lift truck (Model No. 2EC25E, Serial No. A22FC3-62205) and the horn was not functioning. The employer did not remove the vehicle from service, and a service call had not been placed. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.178(l)(6): Certification. The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.
