29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    (a) At the project on or about October 25, 2011, and at times prior thereto, there was no eye protection  worn when a Makita right angle grinder, model 9521NB and a Makita circular saw were used.  The grinder was used to cut and grind the steel frames for the windows and the saw was used to cut 2 x 4s.

29 CFR 1926.303(c)(3): All other portable abrasive wheels used for external grinding, were not provided with safety guards (protection hoods) meeting the requirements of paragraph (c)(5) of this section:     (a) At the project on or about October 25, 2011, and at times prior thereto, there was no guard for the 3.75 inch diameter abrasive wheel on a Makita right angle grinder, model 9521NB.  The grinder was used to cut and grind the steel frames for the windows.

29 CFR 1926.404(b)(1)(i): The employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites:    (a) At the project on or about October 25, 2011, and at times prior thereto, there was no ground fault circuit-interrupter protection or an assured equipment grounding conductor program on the outlets used to power a Makita right angle grinder, model 9521NB, and a Makita circular saw.  The grinder was used to cut and grind the steel frames for the windows, and the saw was used to cut 2 x 4s.       THE HYOSUNG CONSTRUCTION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.404(B)(1)(I) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 311108039, CITATION NUMBER 1, ITEM NUMBER 1, ISSUED ON JULY 10, 2007, WITH RESPECT TO A WORKPLACE LOCATED AT THE TENANT IMPROVEMENT HUSH BAR PROJECT, TUMON, GUAM.
