29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them: a) AB Production Management, 5261 East 119th Court, Thornton, CO: The controlling employer in charge of the jobsite had not ensured that a competent person conducted frequent inspections to identify and correct hazards associated with residential roofing work. On or about October 19th, 2011, the sub-contractors employees were permitted to work on a 5/12 pitch roof without appropriate fall protection. Condition exposed employees to a fall hazard of approximately 15 feet. OSHA defines a "competent person" as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. Abatement Note: Abatement certification is required for this item (See enclosed Abatement-Certification Letter).

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b) Note: If using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502. a) AB Production Management, 5261 East 119th Court, Thornton, CO: The controlling employer in charge of the jobsite had not ensured the use of appropriate fall protection while employees of a sub-contractor removed and installed new roofing shingles. On or about October 19th, 2011, the sub-contractors employees were permitted to work on a 5/12 pitch roof without appropriate fall protection. Condition exposed employees to a fall hazard of approximately 15 feet. Abatement Note: Abatement certification is not required for this item.
