29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds were not fully planked or decked between the front uprights and the guardrail supports: (a) Near the east interior wall on or about October 26, 2011, the platform was not fully planked as there was one 20 inch wide board on the 46 inch wide a tubular welded frame mobile scaffold platform. The plank was about 6 feet, 2 inches above the concrete floor. Employees were on the scaffold to grind down high spots on the concrete wall. (b) On the mezzanine near the north end of the building on or about October 26, 2011, the platform was not fully planked as there was one 20 inch wide board on the 46 inch wide tubular welded frame mobile scaffold. The plank was about 6 feet, 2 inches above the concrete floor. Employees used the scaffold to install electrical boxes on the ceiling. (c) Near the west interior wall on or about October 26, 2011, the platform was not fully planked as there was one 20 inch wide board on the 46 inch wide tubular welded frame mobile scaffold. The plank was about 14 feet, 8 inches above the concrete floor.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used: (a) Near the east interior wall on or about October 26, 2011, safe access was not provided for a tubular welded frame mobile scaffold platform about 6 feet, 2 inches above the concrete floor. Employees were on the scaffold to grind down high spots on the concrete wall and climbed the scaffold's end frames to access the platform. (b) On the mezzanine near the north end of the building on or about October 26, 2011, safe access was not provided for a tubular welded frame mobile scaffold platform about 6 feet, 2 inches above the concrete floor. Employees were on the scaffold to install electrical boxes on the ceiling and climbed the scaffold's end frames to access the platform. (c) Near the west interior wall on or about October 26, 2011, safe access was not provided for a tubular welded frame mobile scaffold platform about 14 feet, 8 inches above the concrete floor. Employees climbed the scaffold's end frames to access the platform.

The platform was about 14 feet, 8 inches above the concrete floor. There was a mid-rail about 24 inches above the platform.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. (a) At the north side of the project on or about October 26, 2011, and at times prior thereto, eye and hand protection was not used while applying a finish coat of Portland cement to the exterior wall. In addition, some employees used gloves with a latex palm side and a fabric back side instead of gloves made of nitrile or bytul.
