29 CFR 1926.651(k)(2):     Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.    The competent person for Oswego Excavating, L.L.C. did not remove employees from an unprotected excavation 6.9 feet deep when soft ground and water in the excavation were encountered.     Theere is no abatement certification or documentation required for this item.

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    On or about October 24, 2011, and on October 25, 2011, Oswego Excavation, L.L.C. employees were not protected from cave-in hazards when they worked in an excavation 6.9 feet deep while laying concrete pipe.      There is no abatement certification or documentation required for this item.
