OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about October 6, 2011 - at the above addressed jobsite, the employer allowed employees to conduct material hoisting operations with a JLG articulating boom lift and a lifting strap. Due to this action the employee was exposed to fall hazards from the articulating boom lift. One feasible and acceptable method to correct this hazard, amoung other means would be for the contractor to follow the JLG safety and opeeraitons manual, Section 1, which specifically states, "Never attempt using the boom as a crane. Structural damage or tipping may occur."

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from anaerial lift.Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable aspart of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under1926.502(e). a. On or about October 6, 2011 - at the above addressed jobsite, an employee performing construction operations from an articulating boom lift approximately 15 to 18 feet above the ground was not protected by a personal fall arrest system, thereby exposing the employee to falls.
